Service Scope & No Guarantee of Results
We provide a system that captures, processes, and responds to customer enquiries through your website and connected channels. We do not guarantee the number of leads, customers, bookings, or revenue generated from using this system. Business outcomes depend on factors outside our control, including your pricing, service quality, response time, and market conditions. By using this service, you acknowledge that generating customers is your responsibility.
Service Delivery
The service is considered delivered once the system has been successfully set up, configured, and made operational on the client’s website or agreed platform. Minor adjustments, third-party limitations, or performance variations do not constitute failure of delivery.
Subscription, Cancellation & Re-activation
This service may be provided on a subscription basis. You may cancel your subscription at any time. Cancellation will stop ongoing service and support. If you later request reactivation, a new setup fee may apply. If your system has been removed, changed, or becomes incompatible during inactivity, a full or partial re-setup may be required.
Service Suspension & Termination
We reserve the right to suspend or terminate the service if payments are overdue, terms are breached, or misuse of the system is detected. You may stop using the service at any time; however, no refunds will be provided for unused subscription periods.
Client Responsibilities
You must provide accurate and complete information required for setup and operation. We are not responsible for issues caused by incorrect information, third-party services, or external platform changes. Delays caused by the client, including failure to provide required information, access, approvals, or third-party accounts, may impact timelines. We are not responsible for delays resulting from such actions.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, including loss of revenue, loss of business, or missed opportunities arising from the use of this service. Our total liability for any claim related to the service is limited to the amount paid by you for the service within the last 30 days. Nothing in this clause excludes rights you may have under the Australian Consumer Law. We do not guarantee uninterrupted or error-free operation of the system at all times.
Third-Party Services
This system may rely on third-party platforms (including messaging providers, hosting services, and APIs). We are not responsible for outages, delays, or failures caused by these external services. Third-Party Costs: Any fees charged by third-party providers (such as SMS services, email providers, hosting platforms, or API usage) are the responsibility of the client unless otherwise agreed.
Intellectual Property
All systems, workflows, logic, and configurations developed by SilixAI remain our intellectual property unless otherwise agreed in writing. You are granted a limited, non-exclusive right to use the system for your business while your subscription (if applicable) is active. You may not copy, resell, distribute, reverse engineer, or replicate the system or its components without our permission.
We reserve the right to reuse general system structures, logic, and non-client-specific components across other clients.
Payments
Payments are processed securely via third-party providers (e.g., Stripe) or approved methods such as bank transfer. We do not store or have access to your full payment details. A one-time setup fee is charged for initial system configuration and onboarding. This fee is separate from any ongoing subscription. Subscription fees (if applicable) are billed in advance for continued use, hosting, and support of the system. Failure to maintain active subscription payment may result in immediate suspension of the service without notice.
Fees & Refunds
The setup fee covers time, labour, and configuration of your system and is non-refundable once work has commenced. Subscription fees are non-refundable once the service period has started, except where required under Australian Consumer Law.
